Several Village A-Bay residents attended tonights VB meeting to voice their concerns regarding a weapon discharged within the village limits. 

Tim Honeywell asked a simple yes or no question: Is it legal to shoot a gun inside village limits....

Reply from acting Chief of Police MullaneyJust depending on what the circumstances are....there are exceptions to the law.........it is allowed.........I have checked with the District Attorney's office.......and thats what I have been told......

These folks are starting to sound a little desperate...Why is the Mayor so blindly crashing through the process to appoint a candidate who is not on the "best qualified" part of the list?
Why does the Village Board sit there without speaking a word on this issue?
Are they too smart to get involved or too dim to see what's happening?
Oh well, Mayor, you're on your way to fulfilling your own prophecy concerning the comment "...maybe I'm wrong, but..."

As a licensed hunter for many years, I took particular interest in this topic. While I can't confirm what the laws are for discharging firearms in the village of Abay, they must not have been re written since the War of 1812. All one has to do is google " discharging a firearm in village limits" and nearly every town in the country has an ordinance against it.

I referred to the NYSDEC Website regarding discharge of a firearm and it mentions " within 500 ft of a dwelling " church school , factory etc." While this person was not " hunting" his domestic dog, I think we can apply this law here.

In summary, I think you have a case here where the village PD investigated the incident, hesitated to make an arrest, then confered with the DA who for whatever reason decided against persuing it further. ( Taking pity on the Dog Owner?) This was a high profile incident with potentially deadly consenquences.
As for the lady who endures threats and vile comments from this indiviual, I suggest you get in touch with the same DA and discuss what your rights are to press charges under any harrassment laws. You don't deserve to live like that.
And as for the village , my guess is you wont make the same mistake again. In the end thankfully nobody was hurt or killed.

On almost any given day in the early evening hours there can be seen on Bolton Ave. in front of mayor Robb's home a village squad car there for usually much better than an hour . Wether it is Mr. mulaney or not the officers of this village are paid to serve and protect citizens of the village . Not to spend hours on duty hanging out with the mayor at his home . Being mayor should not give that type of access to the police force on a daily basis ! That is just plain shadey . What is going on and why hasn't something been done to correct the problem . There should be as much question put on the mayor as there is the present chief of police . Generally if it smells like a rat it probably is !

A Resident that left that click town! I left in 1999 so glad.
It's all a runned down and a shame to
even call it a tourist town! Start with cleaning it up first. You's only
for money isn't going to work without
new clean store front's. Slum area it
look's like!!!!!
